The ESIL Interest Groups on International Environmental Law and on International Economic Law are pleased to announce that the celebration of their First Joint Workshop will place in the afternoon of Wednesday 12th September 2012 (between 6-8pm), that is, the night before the opening session of the Fifth ESIL Biennial Conference, to be held in Valencia (Spain) on September 13-15th 2012. The group convenors hereby invite the submission of abstracts on the theme of « The United Nations ‘Rio+20’ Conference on Sustainable Development: Appraisal and Prospects of a Paradigmatic Concept ».

1) THE TOPIC
Twenty years after the 1992 Rio Summit on Environment and Development and ten years since the 2002 Johannesburg World Summit on Sustainable Development, the international community will again gather between the 4th and the 6th June 2012 in Rio de Janeiro (information available at: www.uncsd2012.org). The objective of this major meeting is to renew and secure political commitment on sustainable development, a paradigmatic concept which has both driven the exponential normative development of international environmental law while also virtually becoming the main framework of global politics for development of the last decades. As it appears in the preparatory work of the Rio+ 20 Conference, the summit will expectedly focus on two themes: green economy in the context of sustainable development and poverty eradication; and institutional framework for sustainable development.
Departing from a discussion on the outcome of the Rio+20 Conference, this Joint Workshop will seek to undertake a comprehensive analysis of the concept of sustainable development. We therefore invite the submission of abstracts which: 1) appraise the historical process of implementation of the concept of sustainable development, exploring its prospects and future evolutions; and/or 2) propose a critical approach to the notion of sustainable development, reflecting about the possible inherent and unveiled shortcomings of the concept.
2) APPLICATION PROCEDURE
The event will be open by the impulse statement of an invited speaker. It will then be followed by three paper presentations selected out of this call for papers which will compose one single panel. A prominent scholar in both fields of International Environmental Law and International Economic Law will conduct the Joint Workshop.
Papers presented at the workshop will be selected through a competitive process. The selection process will be based exclusively on scholarly merit and priority will be given to unpublished papers and work in progress. We welcome proposals from professionals, academics and graduate students, and remain open to proposals which may challenge the importance given by this workshop to the notion of sustainable development as a central issue in the future development of IEL.
Each submission should include the following:
– An abstract of no more than 400 words in English or French.
– A short CV in English or French.

4. DEADLINE
The deadline for submission of proposals is Monday, 23rd April 2012. The outcome of the selection process will be notified to all applicants by Monday, 14th May 2012. After selection, each presenter will be expected to produce a draft paper by Monday, 16th July 2012 for circulation among the other workshop participants.

Crisis Talk at Humboldt University

Isabel Feichtner ha escrito una muy interesante crónica de la conferencia sobre deuda soberana que se organizó en la Universidad Humboldt de Berlín el 13 y 14 de enero. Su post, Crisis Talk at Humboldt University, plantea las preguntas esenciales del debate y se lee con mucho gusto y aprovechamiento. Espero que nuestra conferencia de marzo en Madrid sobre deuda soberana contribuya significativamente a ese importante debate y que Isabel, que participará en la conferencia, haga una crónica tan interesante como la de Berlín.
Quienes estén interesados en leer un análisis jurídico claro, preciso y conciso sobre el tratado para reforzar la unión económica europea pueden leer el artículo que ha escrito José Martín y Pérez de Nanclares para el Instituto Elcano. En su artículo, El nuevo tratado para reforzar la unión económica: una “cura de urgencia” excepcional y transitoria, el catedrático de derecho internacional de la Universidad de Salamanca describe las características principales de este tratado y presenta una serie de dificultades que plantea desde la perspectiva de las instituciones europeas y del derecho de la Unión Europea. Todos esos importantes aspectos no nublan el juicio del autor, para quien, «no conviene sobredimensionar» las dificultades jurídicas.
Por una parte, porque la redacción que se ha dado al borrador de nuevo tratado que se acaba de conocer se cuida mucho de soslayar cualquier atisbo de posible conflicto institucional o jurídico. Por otra parte, porque en realidad el verdadero problema de fondo es en primera línea de naturaleza económica y política: económica en cuanto la intención última de estas medidas es salvar el euro; y política porque lo que late en el fondo del debate es el agotamiento del modelo que en las últimas seis décadas ha servido de fundamento para el proceso de integración.

The Law and Practice of International Courts and Tribunals [10 (2011) 261–284] has published our article: «Inter-jurisdictional Co-operation in the MERCOSUR: The First Request for an Advisory Opinion of the MERCOSUR’s Permanent Review Tribunal by Argentina’s Supreme Court of Justice». Here is the abstract:
This comment discusses the request for an advisory opinion that originated in the case Sancor c/ Dirección General de Aduanas. This case emerged from the resolution of the Argentine Ministry of Economy which set export duties of 5% to certain milk products, without discriminating with regard to the destination of them, i.e. including members as well as non-members of the Southern Common Market (MERCOSUR). In this way, and after a long judicial process, in October 2009 Argentina’s Supreme Court of Justice (CSJN) requested an advisory opinion from the Permanent Review Tribunal of the MERCOSUR, – Tribunal Permanente de Revisión – asking the question “Does the Treaty of Asunción require Member States of MERCOSUR the obligation not to impose duties on exports of goods which are originated in one of them and which have another Member State as its final destination?” This article describes the historical circumstances surrounding the Argentine governmental measure, and then analyzes three specific issues related to the request of the advisory opinion by the Supreme Court: 1) the place of international law in the Argentine legal system; 2) the procedural legitimacy of the decision of the Court; and 3) some substantive issues involved in the requested advisory opinion.

Post- Crisis International Financial Regulation: Fragmentation, Harmonization and Coordination
The challenges of the 2008 financial crisis were severe and prolonged. The international regulatory community struggled to contain, manage and respond to the crisis despite a fragmented and complex set of regulatory sources and an unclear path to coordination let alone harmonization. Still, the urgency brought on by the crisis forced a degree of cooperation and sparked a hope that greater cooperation could emerge amongst the world regulators going forward. As the world emerges from this crisis, whether the ability or desire to forge greater cooperation exists is less than clear.
The International Economic Law Interest Group (IEcLIG) of the American Society of International Law (ASIL) will host a special Research Forum in early December 2011 to discuss the complexities international financial regulation post crisis. The conference will take place at Suffolk Law School on December 2, 2011. We invite the submission of proposals in the form of abstracts of no more than 300 words which will address this topic. Principios de la UNCTAD sobre otorgamiento y toma responsables de préstamos soberanos
ANTECEDENTES DE LA CONFERENCIA
Las causas y los efectos negativos generalizados de la crisis global financiera y económica impulsaron a la UNCTAD a poner en marcha en 2009 una iniciativa para promover prácticas responsables en el otorgamiento y toma de créditos soberanos. El objetivo de la iniciativa de la UNCTAD es proveer de un foro para el debate sobre las prácticas responsables y desarrollar una serie de principios comunes aceptados y prácticas relativas a cuestiones de deuda pública.
Para contribuir con el proceso de redacción de estos Principios fue establecido un grupo de expertos. El grupo está compuesto por expertos en Derecho y Economía de renombre internacional, inversores privados y ONGs. Representantes de alto nivel del FMI, el BM y el Club de París participan en calidad de observadores del grupo. Tras varias reuniones formales e intercambios de ideas, surgió este proyecto de Principios. Dado que este borrador está concebido como un punto de partida para la discusión internacional y que será sometido a los gobiernos para observaciones adicionales, la UNCTAD y la UAM (mediante sus Facultades de Derecho y Ciencias Económicas, y con el apoyo del proyecto DER2009-11436 sobre bienes jurídicos globales) organizarán una conferencia para analizar en profundidad las bases, implicaciones y perspectivas de los Principios y los problemas que se proponen resolver.
El otorgamiento y toma de préstamos soberanos requiere una aproximación interdisciplinar y pluralista. Por ese motivo, la conferencia favorecerá la discusión entre académicos y expertos provenientes de diferentes disciplinas y contextos, con intereses en cuestiones económicas, financieras, jurídicas e institucionales. Las investigaciones originales e innovadoras son bienvenidas teniendo en cuenta que los Principios son novedosos en varios sentidos.
La conferencia tendrá lugar en el campus de la UAM el viernes 2 de marzo de 2012. El programa preliminar estará disponible una vez que se haya hecho la primera selección de propuestas de ponencias. Las ponencias seleccionadas serán publicadas en un libro colectivo del que está prevista una versión en inglés y otra en español.

PROCESO DE SELECCIÓN
Expertos y académicos de todas las categorías, incluyendo candidatos a obtener el grado de doctor, están invitados a participar. Las ponencias serán seleccionadas sobre la base de los resúmenes enviados por los autores para ser considerados en el proceso de selección. Los criterios de selección son: originalidad del trabajo en relación con los temas de la conferencia y equilibrio geográfico de los expositores. Sólo se aceptará un resumen por persona. Los resúmenes no deben exceder las 500 palabras. El trabajo propuesto debe ser original e inédito.
Los trabajos podrán ser presentados en inglés o español. La Conferencia ofrecerá un servicio de traducción simultánea. Sin embargo, los autores que presenten sus trabajos en español deberán entregar una versión escrita en inglés si desean que sus trabajos sean considerados para la publicación en inglés.

UNCTAD’s Principles on Responsible Sovereign Borrowing and Lending
BACKGROUND OF THE CONFERENCE
The causes and widespread negative effects of the global financial and economic crisis prompted UNCTAD to launch an initiative in 2009 to promote responsible sovereign lending and borrowing practices. The purpose of UNCTAD’s initiative is to provide a forum for debate on responsible practices and to develop a set of commonly accepted principles and practices relating to sovereign financing.
An expert group was established to contribute to the process of drafting these Principles. The group is composed of world renowned legal and economic experts, private investors and NGOs. Senior representatives from the IMF, the World Bank and Paris Club participate as observers of this group. After several formal meetings and exchanges of ideas a draft of the Principles emerged. As this draft is intended to be a point of departure for international discourse and will be subject to further discussions with governments, UNCTAD and the UAM (through its schools of Law and Economics, with the support of the project DER2009-11436 on ‘global legal goods’) will organize a conference to discuss in depth the foundations, implications and perspectives of these Principles and the problems they are designed to address.
Since sovereign lending and borrowing require an interdisciplinary and pluralist approach, the conference will encourage discussion among scholars and experts from different disciplines and backgrounds, focusing on economic, financial, institutional and legal issues. The UNCTAD’s initiative being novel in several ways, original and innovative research is especially encouraged.
The conference will take place in the campus of the UAM in 2 March 2012. The preliminary program will be available online as soon as the first selection of papers has been processed. Papers selected will be published in a collective book, one edition in English and another one in Spanish.

APPLICATION PROCEDURE
Senior and junior scholars (PhD students included) and experts are invited to participate. Papers will be selected on the basis of abstracts submitted. Selection criteria are: originality of the work links to the conference theme, and geographical representation of the speakers. Only one abstract per author will be considered. Abstracts must not exceed 500 words. The piece must be original and unpublished.
The papers can be presented in English or Spanish. The conference will provide for simultaneous interpretation into English. However, authors presenting in Spanish who wish to be considered for the English edition of the book must supply a publishable English version of their papers.
In addition, the following information must be provided:
- If possible, the name of the topic for which the abstract is submitted;
- The author’s name and institutional affiliation;
- An author’s brief cv, including a list of relevant publications;
