Overview

The British Red Cross helps people in crisis, whoever and wherever they are. We are part of a global voluntary network, responding to conflicts, natural disasters and individual emergencies.

This British Red Cross (BRC) is a part of the International Red Cross and Red Crescent Movement (Movement). As such, we work to disseminate knowledge of and to encourage respect for international humanitarian law.  We co-operate closely with the International Committee of the Red Cross (ICRC) in these areas.

In January 1995, the Intergovernmental Group of Experts for the Protection of War Victims met in Geneva and adopted a series of recommendations aimed at enhancing respect for international humanitarian law, in particular by means of preventive measures that would ensure better knowledge and more effective implementation of the law.

Recommendation II of the Intergovernmental Group of Experts proposed that:

 The ICRC be invited to prepare, with the assistance of experts in IHL [international humanitarian law] representing various geographical regions and different legal systems, and in consultation with experts from governments and international organisations, a report on customary rules of IHL applicable in international and non-international armed conflicts, and to circulate the report to States and competent international bodies.

In December 1995, the 26th International Conference of the Red Cross and Red Crescent endorsed this recommendation and officially mandated the ICRC to prepare a report on customary rules of international humanitarian law applicable in international and non-international armed conflicts.  The outcome of the research carried out pursuant to this mandate was published in 2005 and consists of two volumes. Volume I contains a list of 161 rules deemed to be part of customary law, and commentary thereto, while Volume II contains the supporting material.

Since 2005, Volume I has been translated into Arabic, Chinese, Farsi, French, Russian, Serbian, Spanish and Turkish. Translations of Volume I into Japanese and Portuguese are expected to be published soon. Although there are no current plans to update Volume I, work has been continuing since 2007 to update Volume II. This work is being conducted through a joint project of the ICRC and BRC, based at the Lauterpacht Centre for International Law, University of Cambridge.

The purpose of updating Volume II is for government and military lawyers, legal practitioners, judges, legal personnel of international organisations and non-governmental organisations, legal officers of the Movement and academics to have easy access to accurate, extensive and geographically diverse information on practice in the field of international humanitarian law. It will also facilitate a possible future update of Volume I.

Since August 2010, both Volume I and Volume II have been freely available online through the ICRC’s Customary IHL Database.

Scope

The post holder will be part of a three-person research team based at the Lauterpacht Centre for International Law at the University of Cambridge. The work is co-ordinated and overseen on a day-to-day basis by a team leader. The researchers are employed by the BRC and for these purposes, report to the Head of International Law of the BRC.

The substantive work of the researchers is carried out under the direct supervision of the head of project, i.e. the ICRC legal adviser in charge of the project on customary international humanitarian law. The head of project will be in regular communication with the team from Geneva via telephone and email and, from time to time, will travel to Cambridge to meet with the team and evaluate progress.

Overall Purpose of the Post

To up-date the collection of practice supporting the ICRC Study on Customary International Humanitarian Law.

Simon Lester (IELP) has posted this call to apply for two research positions to participate in a very interesting project called «Clean Trade».

The Clean Trade project is based on the premise that the citizens of each country have the ultimate right to control the natural resources of their country. As common Article 1 of the human rights covenants states, “All peoples shall, for their own ends, freely dispose of their natural wealth and resources.” Yet the people of the world’s worst authoritarian and failed states have no way to control their territory’s oil, metals and gems. Clean Trade aims to stop the authoritarians and militias in these countries from enriching themselves by selling off what are, essentially, stolen goods.

Clean Trade has received a substantial grant from the Leverhulme Foundation for research on two distinct areas of its policy framework.

1. A legal researcher with expertise in WTO/GATT regulations and recent dispute resolution is required. Part of the Clean Trade framework recommends imposing duties on imports from trade partners who buy natural resources from the worst authoritarians and militias. The researcher will write a brief setting out the strongest case for these duties in response to a challenge in the WTO. GATT Article XX will be one foundation for this case; further strategies for defending against a challenge may also be explored.

2. A legal researcher with expertise in conflict of laws, and knowledge of public international law, is required to write a guide for lawyers wanting to bring Clean Trade legal actions. The aims of these actions will be (a) to pressure international resource corporations not to deal with the worst actors in exporting states; and (b) to pressure governments to impose trade sanctions on the worst regimes. The guide will extrapolate from recent cases to catalogue promising approaches to litigation, especially in the UK / US / EU. The Alien Torts Statute in the US will define one approach; others strategies may be based on ‘ill-gotten gains,’ financial loss to shareholders, corporate pillage, state complicity in a second state’s human rights violations, etc.

Candidates should be accustomed to doing independent work. The two researchers may, if they wish, also choose to work collaboratively. The results of the research will be checked for quality by experts in the respective areas of law.

European Regulatory Private Law

The main hypotheses of the project

The project is sponsored by the ERC and focuses on European Private Law (ERPL) beyond the boundaries of national private legal orders, which are guided by autonomy and freedom of contract. This socio-legal project focuses on the search for a normative model which could shape a self-sufficient European private legal order in its interaction with national private law systems.

(1) It aims at a new orientation of the structures and methods of European private law based on its transformation from autonomy to functionalism in competition and regulation.
(2) It suggests the emergence of a self sufficient European private law, composed of three different layers (a) the sectorial substance of ERPL, (b) the general principles –provisionally termed competitive contract law – and (c) common principles of civil (or private?) law.

The project elaborates on the interaction between ERPL and national private law systems around four normative models: intrusion and substitution, conflict and resistance, hybridisation and convergence.

Each candidate shall work in one of the fields indicated below

(1) 1 project on regulated markets. The major objective is to test the hypothesis of selfsufficiency of the emerging European private legal order. The project should ideally cut across the different sector related rules and cover the following countries: United Kingdom and Sweden (administrative governance), France and Italy (political governance), Germany (judicial governance). An experienced researcher with a PhD in regulated markets and good knowledge in institutional and behavioural economics is most suited in fulfilling this aspect of the research. The position is a fixed contract for two years.
(2) 1 project on remedies in European regulatory private law to test the reach of hybridisation, cutting across judicial, administrative and political enforcement/governance and encompassing individual as well as collective enforcement. The countries to be investigated should be selected along the lines of the
different enforcement/government structures, UK, NL, Nordic countries, Germany, Italy or France. A PhD reseacher familiar with European primary law, educated in comparative law and with experience in enforcement studies is required. The position is a fixed contract for four years.
(3) 1 project on co-/self-regulation in the field of standardisation of services, testing the convergence hypothesis. Co-/self-regulation in the field of services is still a black box. The project would allow to investigate SME’s which are mostly concerned. Outside and beyond the UK, Germany, France or Italy as well as Nordic countries, particular emphasis should be put on the new Member States since old Member States are very much concerned by cross-border services affecting their legal orders. The project should be executed by a PhD researcher preferably from Eastern Europe trained in comparative law and European law. The position is a fixed contract for four years.

Qualifications, Salaries, Project obligations

The PhD candidate shall hold a law degree with excellent results, which enables him for a PhD in law in the candidate’s home country. The candidate for the post-doc position shall obtain a PhD in law defended no longer than three years ago or be in the final year of his completion. In the latter case, a letter of the supervisor shall accompany the application where the supervisor indicates when completion of the PhD is expected.

For all positions, previous working experience in an international environment is an asset.High level of English speaking and writing skills is indispensable. Please also provide contact details of three references.

The members will be part of a project team. The candidates are expected not only to work on the candidate’s respective project but to support the execution of the overall project, which requires the organisation of workshops, conferences, short and long term stays. Sufficient time to conduct the researcher’s projects will be guaranteed. Phd researchers are eligible for a PhD at the EUI in Florence. All collaborators have to take residence in Florence or Fiesole. The project will start in September 2011 at the latest. Annual payment for PhD researchers max EUR 36.000 brut, for post doc max EUR 54.000 brut, net salary depending on the civil status. Researchers and post docs, having a full-time contract, are covered by the Institute’s accident and health insurance. For contracts of at least 12 months (or prolonged beyond 12 months) an amount equivalent to 16,5% of the basic salary will be paid upon termination of service as severance.
